The Frankford woman accused of destroying and tampering with evidence during a murder trial was recently awarded a new judge.
40-year-old Rebecca Kirk has been charged in Pike County with two felony counts of tampering with evidence. During her March 26 arraignment, the suspect entered a plea of not guilty.
On March 28, John B. Morthland, defense attorney, entered a motion for a change of judge. It was announced Wednesday that Kirk will now be seen before Judge Ben Burkemper Jr. of the Pike County Circuit Courts.
Kirk is accused of damaging or trying to destroy a rifle, ammunition and clothing at the request of Calvin Duane Petty, her then lover, on April 15 of 2010. Petty was having an affair with Kirk while he was engaged to the late Sandra Fugate.
Pettey was convicted of murdering Fugate last June.
Kirk admitted on the witness stand at Petty’s trial that she acted on his request to destroy the evidence.
Kirk will be seen for a case review May 6. The pre-trial hearing and jury trial the defendant was scheduled to face later this year were cancelled due to the change of judge.
